Default accident advice: corvette vs. truck

got in a wreck on the way to work today. the vette will be one year old next monday. in 19 years of driving, this is the first time a vehicle that i operated was contacted by another vehicle. my ego is hurt more than the car. it's quite obvious what happened; i got 'ben hur-ed'. the front wheel of the truck was a dually type with 10 long studs and lugs. at least it didn't happen to the classics, right? anyway, the CHP showed up, took statements. no witnesses, my word against his. no tickets, either. so the insurance companies will arbitrate. whose at fault here? any practical experience will be greatly appreciated. i've dealt with vehicle damage, body shops, and insurance companies, but never involving another vehicle. here's the damage (needless to say my $4,600 in damages overshadows his dirty wheel) :

all depends HOW it happened...he trned into your lane? it was in a turn? staright away with 2 or more lanes?
witnesses?

last time I was in a wrck (in my Volvo 780) I MADE money off it....about $1000 plus..
got a used fender same color , just bolted on...new head light, p light/blinker off EBay fr $25...etc...

blackcat: true, but the guy that did it was really worried about losing his job. the CHP hinted that there would be no report filed and he was practically begging him to write one. whether the filing of an accident report would have cost the man his job or not, i believe that he truly believed that it would. to his credit, after the adrenaline wore off, he was very civil and seemed like a nice guy. if i'm going to get into an accident, why can't it be someone who has is coming, right?

bjorn: this was an on-ramp interchange from one interstate to another. 2 into one with no arrows for merge responsibility, then a 1 into 1 from downtown followed by 4 lanes of new interstate. i was in the right lane following suit from left, right (18 wheeler), left, right (me), left (him). i was ahead of him in the middle of the lane before the 1 into 1 and he managed to hug the left and when traffic (single file) slowed because of the 18 wheeler going uphill, he got 3 feet ahead of my rear end and corrected to the center, exactly where i was. he is 5'5" tall in a big truck where the hood is taller than my roof. he proclaimed 3 times that he couldn't see me and even asked for me to get in his truck to prove it. again, this is 'he said, he said'.

Sounds like a typical traffic merging scenario to me and it looks as though his front end hit your back end. I would say its more his fault than yours especially given the other driver admitted he did not see you. Those merge signs are there for a reason.
And yes, "at least it didn't happen to the classics, right?" You got that right!

That sucks. I got run off the road by a 18 wheeler last August and the damage wasn't as severe as that. I got really lucky.

I would bet the insurance companys decide to have each vehichle repaired by their own insurance but stand your ground and go to court.

Was the truck a company vehicle? Contact the company to see if they filed a claim.

thanks, guys. the truck is a company truck, but with no damage, i bet they don't file a claim. i have USAA and they said they would work with his company's insurance and assign liability through arbritration. as long as i'm not over 51% liable, my rates won't go up. the more it is his fault, the more of my $500 deductable i will get back.

As a general rule(there are some exceptions) if the front of your car makes contact with the back of another. It's your fault.
He was in a commercial vehicle. if he hits ANYTHING he MUST BY LAW fill out an accident report.
Go to his company(safety director) and tell them to have your car fixed by a GM dealer or you'll take them to court.
My bet is he will tell you to have it fixed and THEY will pay the bill.
They have 1 million dollars liability. They DON"T want it to go to court.
