Agree with others here. The current shop/transaction has gone sour and your car hasn't even rolled in yet. I can't imagine how badly this deal is going to go from here if you stick with them. One way or another, get your refund or the transmission as a carryout and find a new shop to install. It's been 3 months and all they have done is take your money so far.
